TERMS OF SERVICE
Please read this Terms of Service Agreement (the “Agreement”) carefully. Your use of the Open Foris Support (“Forum”) constitutes your agreement to be bound by this Agreement.
This Agreement is between you (“you”) and the Food and Agriculture Organization of the United Nations (“FAO”) concerning your use of the Forum at the Open Foris website. The Open Foris website is hosted by FAO, Forestry Department.
Purpose of the Forum. The Forum is a Q&A platform providing technical support in relation to the use of the free and open-source software tools put at disposal of the users through Open Foris.
Registration; User Name and Password. You will be required to register in order to access the Forum. Registration can be done through Facebook or Twitter, or by creating an account. To create the account, the only personal information you will be asked to provide is your email address. You will create your user name and password. FAO reserves the right to refuse to grant you, and you may not use, a user name (or e-mail address) that violates the intellectual property or other rights of any person; that is offensive; or that FAO rejects for any other reason in its sole discretion.
Your user name and password are for your personal use only, and not for use by any other person. You are responsible for maintaining the confidentiality of any password you may use to access the Forum, and agree not to transfer your password or user name, or lend or otherwise transfer your use of or access to the Forum, to any third party. You are fully responsible for all interaction with the Forum that occurs in connection with your password or user name. You agree to immediately notify FAO of any unauthorized use of your password or user name or any other breach of security related to your account or the Forum, and to ensure that you “log off”/exit from your account with the Forum (if applicable) at the end of each session. FAO will not liable for any loss or damage arising from your failure to comply with any of the foregoing obligations.
By registering as a member of the Forum you will have access to the content provided by FAO or by other members (the “Forum Content”). All the Forum Content is public.
Rules of Conduct. While accessing and using the Forum you will comply with all applicable laws, rules and regulations. In addition, FAO expects users of the Forum to respect the rights and dignity of others. Your use of the Forum is conditioned on your compliance with the rules of conduct set forth in this section; your failure to comply with such rules may result in termination of your access to the Forum.
You agree that you will not:
a) Post, transmit, or otherwise make available, through or in connection with the Forum:
- Anything that is not related to the purpose of the Forum described above.
- Anything that is or may be (a) threatening, harassing, degrading, hateful or intimidating; (b) defamatory; (c) fraudulent or tortious; (d) obscene, indecent, pornographic or otherwise objectionable; or (e) protected by copyright, trademark, trade secret, right of publicity or other proprietary right without the express prior consent of the owner of such right.
- Any material that would give rise to criminal or civil liability; that encourages conduct that constitutes a criminal offense; or that encourages or provides instructional information about illegal activities or activities such as "hacking," "cracking," or "phreaking."
- Any virus, worm, spyware, or other computer code, file, or program that is harmful or invasive or may or is intended to damage or hijack the operation of, or to monitor the use of the Forum.
- Any unsolicited or unauthorized advertising, promotional material, "junk mail," "spam," "chain letter," "pyramid scheme" or investment opportunity, or any other form of solicitation.
b) Use the Forum for any fraudulent or unlawful purpose.
c) Use the Forum to defame abuse, harass, stalk, threaten or otherwise violate the legal rights of others, including without limitation others' privacy rights or rights of publicity.
d) Impersonate any person or entity, including without limitation any of FAO’s (or its affiliates) representatives; falsely state or otherwise misrepresent your affiliation with any person or entity; or express or imply that FAO endorses any statement or posting you make.
e) Interfere with or disrupt the operation of the Forum or the servers or networks used to make the Forum available.
f) Restrict or inhibit any other person from using the Forum (including without limitation by hacking or defacing any portion of the Forum).
g) Use the Forum to advertise or offer to sell or buy any goods or services.
h) Reproduce, duplicate, copy, sell, resell or otherwise exploit for any commercial purposes, any portion of, use of, or access to the Forum.
i) Modify, adapt, translate, reverse engineer, decompile or disassemble any portion of the Forum.
j) Remove any copyright, trademark or other proprietary rights notice from the Forum or materials originating from the Forum.
k) Frame or mirror any part of the Forum without FAO’s express prior written consent.
l) Create a database by systematically downloading and storing all or any Forum content.
Links. The Forum may contain links to other web sites and online resources. Links to other web sites are provided for your convenience and do not constitute endorsement by FAO of material at those sites, or any associated organization, product or service. Because FAO has no control over such sites and resources, you acknowledge and agree that FAO is not responsible for the availability of such external sites or resources, and FAO neither endorses nor is responsible or liable for any content, advertising, products or other materials on or available through such sites or resources.
Forum content. Forum content may be provided by FAO as well as by members of the Forum. Members may post messages, provide links or materials or make statements.
Karma points. Karma is a rating system, by which members receive points when they answer questions or interact with other members of the forum.
Disclaimers; Limitation of Liability. The Forum and any information and materials made available through or in connection with it are provided to you "as is” without any express representations or warranties of any kind on FAO’s part. YOUR USE OF THE FORUM AND RELIANCE ON ANY FORUM CONTENT IS SOLELY AT YOUR OWN RISK.
While the information contained in the Forum is periodically monitored and updated, FAO makes no representation or warranty that the Forum (or any part thereof) is or will be accurate, complete or error-free. You hereby agree that it is your sole responsibility to evaluate, and that you bear all risks associated with, the use of the Forum, including without limitation, any reliance on the accuracy, completeness or usefulness of any information available through the Forum.
The opinions expressed in the Forum reflect solely the opinions of the individuals who submitted such opinions, and may not reflect FAO’s opinions.
The designations employed in the Forum do not imply the expression of any opinion whatsoever on the part of FAO concerning the legal status of any country, city or area or its authorities, or concerning the delimitation of its frontiers or boundaries.
FAO shall not not responsible for any inaccuracy, error, omission, interruption, deletion, defect, alteration of or use of any content of the Forum, or for its timeliness or completeness, nor shall it be liable for any failure of performance, computer virus or communication line failure, regardless of cause.
Under no circumstances will FAO be liable to you or anyone else for any loss or damage arising out of use, reference to, or reliance on the Forum content or for any results obtained by using any such Forum content. FAO will not be liable for damages of any kind resulting from your use of or inability to use the Forum or from any content posted on the Forum.
Responsibility. You agree to address all claims, losses, costs and expenses, including any grievances brought against FAO arising out of your use of, or activities performed in connection with, the Forum.
Applicable Rules. Your registration to the Forum, all information provided by you in relation to the Forum and any other document related thereto, including this Agreement, shall be subject to FAO’s rules, policies and practice, to the exclusion of any single national system of law.
Privileges and Immunities. Nothing in this Agreement, nor any acts performed or statements made in relation to the Forum, shall be deemed a waiver, express or implied, of any of the privileges and immunities of FAO, or as its acceptance of the jurisdiction of the courts of any country over disputes arising out of this Agreement.
FAO emblem and logo. The official emblem or logo of FAO, shall not, under any circumstances, be used without FAO's prior written consent, nor represent or imply an association or affiliation with FAO.
Modification of Services and Termination. FAO reserves the right at any time, and from time, to time to modify or discontinue, temporarily or permanently, the services provided through the Forum, including any means of accessing or utilizing them, at its sole discretion with or without prior notice to you.
FAO may at its sole discretion, under any circumstances, for any or no reason whatsoever and with or without prior notice to you, terminate your access to the Forum, including to any means of accessing or utilizing it. Upon any such termination, your right to use the Forum will immediately cease. You agree that any termination of your access to or use of the Forum may be effected without prior notice, and that FAO may immediately deactivate or delete your password and user name, and all related information and files associated with it, and/or bar any further access to such information or files. You agree that FAO shall not be liable to you or any third party for any termination of your access to the Forum or to any such information or files, and shall not be required to make such information or files available to you after any such termination.
Amendments. Changes to this Agreement will be posted on this webpage. By continuing to use the Forum subsequent to FAO making available amendment(s) to this Agreement, you acknowledge, agree and consent to such amendment(s).
